Webber Wealth Holdings LLC is a company specializing in offering homes for sale through rent-to-own arrangements, enabling individuals seeking housing to lease properties with an option to purchase them in the future.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services. These Terms incorporate by reference our Privacy Policy, which describes how we handle your personal information.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website or through other communications. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
## 1. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use our Services. By using the Services, you represent and warrant that you meet these eligibility requirements. If you are using the Services on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

Our Services include:
- Property Listings and Information: Access to listings of homes available for rent-to-own arrangements, including property details, photos, virtual tours, and pricing information.
- Rent-to-Own Programs: Facilitation of lease agreements with an option to purchase ("Rent-to-Own Agreements"). Under these programs, you may lease a property while building equity toward eventual ownership, subject to meeting specific terms such as timely payments and maintenance responsibilities.
- Consultations and Support: Personalized consultations with our team to assess your housing needs, financial qualifications, and suitability for rent-to-own options.
- Application and Approval Process: Submission of applications for rent-to-own opportunities, including credit checks, background verifications, and financial reviews.
- Online Tools: Features such as account portals for tracking payments, viewing lease details, and managing your rent-to-own progress.
- Related Services: Referrals to third-party providers for financing, home inspections, insurance, or legal advice, where applicable.
All Services are provided "as is" and subject to availability. We do not guarantee that any specific property will be available or that you will qualify for a rent-to-own arrangement.
## 3. User Accounts
To access certain features of our Services, you may need to create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and notify us immediately of any unauthorized access.
- Be responsible for all activities that occur under your account.
We reserve the right to suspend or terminate your account if we suspect fraudulent activity, violation of these Terms, or for any other reason in our sole discretion.
## 4. Rent-to-Own Agreements
If you enter into a Rent-to-Own Agreement through our Services:
- Lease Terms: You will be required to sign a separate lease agreement outlining rental payments, duration, maintenance obligations, and other conditions. A portion of your rent may be credited toward the purchase price if you exercise the option to buy.
- Option to Purchase: The agreement will include an option fee (non-refundable) and terms for exercising the purchase option, including the purchase price, closing timeline, and any contingencies (e.g., obtaining financing).
- Payments: All payments must be made on time via approved methods (e.g., electronic transfer, check). Late payments may incur fees and could void the purchase option.
- Property Maintenance: As a tenant, you are responsible for routine maintenance and repairs, unless otherwise specified in the agreement. Major repairs may be our responsibility.
- Termination: Failure to comply with the agreement may result in eviction, forfeiture of credits, and loss of the purchase option. We comply with applicable landlord-tenant laws.
- No Guarantees: Qualification for rent-to-own does not guarantee approval for final purchase financing. You are encouraged to improve your credit and financial standing during the lease period.
Rent-to-Own Agreements are governed by the laws of the state where the property is located and may require additional disclosures under federal laws like the Truth in Lending Act (TILA) or Real Estate Settlement Procedures Act (RESPA).
## 5. User Conduct and Responsibilities
You agree not to:
- Use the Services for any illegal or unauthorized purpose.
- Misrepresent your identity, financial status, or intentions.
- Interfere with the operation of the Services, including hacking, transmitting viruses, or overloading systems.
- Copy, reproduce, or distribute any content from our Services without permission.
- Harass, threaten, or discriminate against others through our platforms.
- Submit false or misleading information in applications or communications.
You are responsible for any taxes, fees, or costs associated with your use of the Services, including those related to property transactions.
## 6. Payments and Fees
- Rent-to-Own Fees: These may include application fees, option fees, security deposits, and administrative charges, as detailed in your agreement.
- Payment Processing: We use third-party processors for payments. By providing payment information, you authorize us to charge you for applicable fees.
- Refunds: Application and option fees are generally non-refundable. Refunds for other charges will be handled per the specific agreement or as required by law.
- Late Fees: Overdue payments may incur late fees, interest, or other penalties as specified.
All fees are subject to change with notice.
## 7. Intellectual Property
All content on our Services, including text, images, logos, and software, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without our written permission, except for personal, non-commercial use.
## 8. Third-Party Links and Services
Our Services may contain links to third-party websites or integrate third-party services (e.g., credit reporting agencies, lenders). We are not responsible for the content, privacy practices, or actions of these third parties. Your interactions with them are governed by their terms.
## 9. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS.
## 10. Indemnification
You agree to indemnify, defend, and hold harmless Webber Wealth Holdings LLC, its officers, directors, employees, and agents from any claims, losses, or damages arising from your violation of these Terms, misuse of the Services, or any Rent-to-Own Agreement.
## 11. Dispute Resolution
Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in North Carolina, under the rules of the American Arbitration Association, unless otherwise required by law. You waive the right to participate in class actions.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws principles.
## 12. Termination
We may terminate or suspend your access to the Services at any time, with or without cause or notice. Upon termination, your obligations under these Terms (e.g., indemnification, payment) survive.
## 13. Miscellaneous
- Force Majeure: We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, pandemics).
- Severability: If any provision is invalid, the remaining provisions remain in effect.
- No Waiver: Failure to enforce any right does not constitute a waiver.
- Entire Agreement: These Terms, along with any incorporated policies or agreements, constitute the entire agreement between you and us.
